Oxford Workers’ Compensation Attorneys

Trusted representation for Mississippi employees hurt on the job

In Mississippi, if you become injured at work, or if you have been diagnosed with an occupational illness, you may be eligible to receive workers' compensation benefits. The workers' compensation program is administered by the state and has been developed to be an easily accessed, no-fault temporary disability benefits program. In exchange for not suing their employer when they get injured at work, employees receive easy access to temporary disability benefits and medical coverage. It all works well until a worker is injured and discovers that their employer does not have workers' compensation insurance, or maybe their insurer denied the worker's claim. That is when you might benefit from the skilled services of a Mississippi workers' compensation attorney.

At Merkel & Cocke, P.A., our Oxford workers' compensation lawyers work as a team. If you were our client, you would benefit from our more than 200 years of combined legal experience working on your behalf. When you are facing a dispute with your employer's workers' compensation insurer, we are here to protect your rights and make sure that you receive the compensation that is due to you.

What does Mississippi workers' compensation benefits cover?

The Mississippi workers' compensation program covers the medical expenses, which includes your visits to the doctor, hospitalization, prescription medications and any other reasonable medical treatment required for your injury or occupational disease. The program will also reimburse your mileage traveling back and forth to doctor visits.

If your injury requires you to miss time from work while you are healing, workers' compensation will pay you temporary disability benefits, which you will receive until your injury has healed, or your doctor has decided that you have reached maximum medical improvement (MMI) and you can return to work, or if you have not healed sufficiently to return to work they usually end after 450 weeks. Temporary partial disability benefits are available if you return to work but find that you are unable to do the work you did before the injury. These benefits will be a portion of the difference between your weekly wages prior to the injury and what you are able to earn after the injury.

Additional benefits include compensation for permanent impairments such as when you lose a limb or become blind or lose your hearing. For the loss of use of body parts Mississippi offers a scheduled loss of use award which compensates the worker for the loss of the use of the body part or sense. There is also compensation for disfigurement for permanent injuries to the head, neck or face.

Death benefits in the form of a weekly check and funeral expenses can be paid to a worker's spouse if they perish in a work-related accident.

Can I work with my own doctor while receiving workers' compensation benefits?

Yes. In Mississippi, you can choose your own doctor. You must notify your employer right away of your choice of doctor. Otherwise, you may end up working with a doctor appointed by your employer's workers' compensation insurer.

What if my workers' compensation claim was denied?

There are many reasons your workers' compensation claim might be denied including:

  • They do not think your injury is serious enough
  • There is no need to take time off or work to recover from your injury
  • Your injury does not require medical treatment
  • Your injury is not a workplace injury

If your injury was in fact a workplace injury, there were witnesses to the incident, and you notified your employer immediately after the incident and sought medical attention, but your employer's insurer still denies your claim, you may consider contacting a skilled Oxford workers' compensation attorney to discuss your next steps. You can request a hearing with the Mississippi Workers' Compensation Commission to appeal the denial.
